These Terms of Service (these "Terms") set forth the conditions for using the mobile applications (collectively, the "Apps") developed and provided by Cabana.Inc ("we", "us", or "our"). By using the Apps, you are deemed to have agreed to these Terms.
Article 1 (Application)
These Terms apply to all relationships between you and us regarding the use of the Apps.
Article 2 (Content of the Apps)
The features of each App are as described on its App Store product page and within the App. We may change, add to, suspend, or terminate the Apps without prior notice to users.
Article 3 (Paid Plans)
1. The Apps may offer certain features as paid plans (including auto-renewable subscriptions). Prices and durations are displayed on the purchase screen within each App.
2. Payments are processed by Apple Inc. through your Apple ID. We do not directly handle any payment information.
3. Auto-renewable subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. The renewal fee is charged to your Apple ID within 24 hours before the end of the current period.
4. You can cancel a subscription yourself in the Apple ID subscription management screen, accessible from the iOS Settings app. After cancellation, you can continue to use the paid plan until the end of the period you have already paid for. No prorated or other refunds are provided.
5. If a free trial is offered, it automatically converts to a paid subscription and billing begins when the trial period ends, unless canceled before the end of the trial. Any unused portion of a free trial is forfeited when you purchase a paid subscription.
6. Refunds are processed through Apple in accordance with App Store policies. Apple determines whether a refund is granted.
Article 4 (Intellectual Property)
All intellectual property rights in and relating to the Apps belong to us or to third parties holding legitimate rights. You may use the Apps only within the scope of personal, private use.
Article 5 (Prohibited Conduct)
When using the Apps, you must not engage in any of the following:
1. Conduct that violates laws or public order and morals
2. Reverse engineering, decompiling, disassembling, or otherwise analyzing the Apps
3. Copying, modifying, redistributing, selling, or lending the Apps
4. Conduct that interferes with the operation of the Apps
5. Any other conduct that we deem inappropriate
Article 6 (Health and Safety Disclaimer)
1. The Apps do not provide medical or health advice.
2. If you use the Apps to assist with exercise or other physical activity, you do so at your own risk and judgment, paying due attention to your own health condition. Consult a physician in advance if necessary.
3. We accept no liability for injury, ill health, or any other damage arising during or after the use of the Apps.
Article 7 (Disclaimer)
1. We do not warrant that the Apps are free from defects in fact or in law, nor that they are fit for any particular purpose.
2. Measurements based on GPS or other sensors (such as distance and pace) are reference values, and we do not guarantee their accuracy.
3. We are not liable for any damage you incur through the use of the Apps, except in cases of our willful misconduct or gross negligence. Even where we are liable, our liability is limited to the amount you paid for the relevant App during the preceding 12 months.
Article 8 (Changes to These Terms)
We may change these Terms without prior notice to users when we deem it necessary. The revised Terms take effect when posted on this page. By continuing to use the Apps after a change, you are deemed to have agreed to the revised Terms.
Article 9 (Governing Law and Jurisdiction)
These Terms are governed by and construed in accordance with the laws of Japan. Any dispute arising in connection with the Apps shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location.
